MISDEMEANOR DIVERSION PROGRAM
The Elkhart County Prosecutor's Office Misdemeanor Diversion Program was created to allow citizens who have been charged with certain misdemeanor offenses an opportunity to have their misdemeanor offense dismissed pending the completion of the program's requirements. The Misdemeanor Diversion Program is offered only at the discretion of and through a referral by an Elkhart County deputy prosecuting attorney. Program requirements are determined by a deputy prosecuting attorney and/or the program coordinator. Program requirements vary depending on the specific misdemeanor offense with which the participant has been charged. The program's duration is 12 months. If the participant pays the program fees and completes the program requirements, upon the 12-month anniversary of the participant starting the program, the participant's misdemeanor offense is dismissed.

Costs
Non-Traffic-Related Misdemeanors
Persons who have been charged with non-traffic-related misdemeanors and who are accepted into the program must pay a misdemeanor diversion fee.
Traffic-Related Misdemeanors
Persons who have been charged with traffic-related misdemeanors and who are accepted into the program must pay a misdemeanor diversion fee.
